TERMS AND CONDITIONS

TIVOLI HOMES – SOCIAL MEDIA GIVEAWAY

 

 

1. ORGANIZER

This promotion is organized by Tivoli Homes, a company operating in the State of Oklahoma, United States (hereinafter referred to as “the Organizer”).

 

 

2. PROMOTION PERIOD

The promotion will begin on January 1, 2026 and will end on December 31, 2026. Entries submitted outside of this period will not be eligible.

 

 

3. ELIGIBILITY

Participation is open to individuals who meet the following requirements:

  • Must be at least 21 years of age at the time of entry
     

  • Must be legal residents of the United States
     

  • Must comply with all instructions outlined in the official promotion post
     

Only individuals aged 21 or older may be awarded prizes. In the event that a minor is selected as a winner, a legal guardian or parent over the age of 21 must be present at the time of prize delivery and will be responsible for receiving the prize on the minor’s behalf.

Employees, affiliates, contractors, and immediate family members of Tivoli Homes may be excluded from participation at the Organizer’s discretion.

This promotion is void where prohibited by law.

 

 

4. HOW TO PARTICIPATE

Participants must follow the instructions specified in the official social media post or promotional material, which may include but are not limited to:

  • Following Tivoli Homes’ official social media accounts
     

  • Liking and/or sharing the promotional post
     

  • Commenting or tagging other users
     

  • Completing a form or providing contact information
     

The Organizer will publish the promotion mechanics through its official social media channels, clearly outlining the participation requirements and instructions.

  • The Terms and Conditions will be publicly available and accessible to all users
     

  • The promotion will be visible to both followers and non-followers of Tivoli Homes
     

  • Any eligible user who meets the stated requirements may participate
     

Additional participation requirements:

  • Participants must be residents of the United States
     

  • Participants must have an active social media account with authentic engagement (no fake accounts or bots)
     

  • Accounts created solely for giveaways or showing repetitive participation in multiple giveaways may be disqualified at the Organizer’s discretion
     

  • Only one entry per person/account may be considered unless otherwise stated

Only entries that fully comply with the stated requirements will be considered valid.

The Organizer reserves the right to disqualify any participant who does not comply with these Terms and Conditions or engages in fraudulent or abusive behavior.

 

 

5. PRIZES

The prize(s) will be described in the official promotion post on Tivoli Homes official profiles such as Facebook, Instagram, TikTok, Youtube, Zillow and LinkedIn.

  • Prizes are non-transferable and may not be exchanged for cash or any other alternatives

  • The Organizer reserves the right to substitute a prize of equal or greater value if necessary

  • The Organizer does not guarantee any warranty beyond that provided by the manufacturer, if applicable
     

 

 

6. WINNER SELECTION AND NOTIFICATION

Winners will be selected at random using third-party tools designed to ensure fairness and transparency, such as but not limited to:

These tools operate independently and are not subject to manipulation by the Organizer.

The selection process will be conducted in a fair and transparent manner and in accordance with the method described in the official promotion post.

  • Winners will be announced through Tivoli Homes’ official communication channels

  • Winners may also be contacted directly via direct message, email, or phone

It is the participant’s responsibility to monitor their messages and notifications.

If a selected winner cannot be contacted or fails to respond within 30 days after the winner has been announced on Tivoli Homes’ social media platforms, the Organizer reserves the right to select an alternate winner.

 

 

7. PRIZE DELIVERY

The Organizer will coordinate the delivery of prizes based on the specific conditions outlined in each promotion.

  • Prize delivery details, including location and method of delivery, will be determined by the Organizer and communicated directly to the winner
     

  • The Organizer reserves the right to decide whether the prize will be:
     

    • Delivered to the winner’s address, or
       

    • Collected by the winner at a previously agreed location
       

The Marketing team of Tivoli Homes will be responsible for coordinating all communication related to prize delivery.

Winners will be contacted through the official Tivoli Homes social media profiles to arrange delivery details.

 

 

8. UNCLAIMED PRIZES

In the event that a selected winner does not respond or fails to claim the prize within the established timeframe:

  • If no response is received within 36 hours after initial contact, the Organizer may attempt a second notification
     

  • If the winner fails to respond within the 30-day claim period, the prize will be considered forfeited
     

Any unclaimed or forfeited prizes may be reassigned, reserved for future promotions, or donated at the Organizer’s sole discretion.

 

 

9. PRIZE CLAIM PROCESS AND VALIDATION

The Organizer will conduct a verification process prior to confirming any winner.

This process may include:

  • Manual review of the winner’s social media profile to confirm compliance with participation requirements
     

  • Verification that the account is active, authentic, and not created solely for giveaways
     

  • Validation that the participant followed all required steps outlined in the promotion
     

The Organizer may maintain an internal database of previous winners for validation and audit purposes.

The selection and validation process may include a maker-checker methodology, where the Marketing team performs a secondary review to ensure fairness and compliance.

The Organizer reserves the right to audit or review the tools used for random selection periodically to ensure transparency and security.

 

 

10. WINNER NOTIFICATION AND DATA COLLECTION

Winners will be notified through:

  • A comment on the original promotional post
     

  • A direct message sent through the same social media platform
     

Upon notification, the winner may be required to provide the following information via direct message:

  • Full name
     

  • Phone number
     

  • Valid government-issued identification (driver’s license or passport)
     

  • City and state of residence
     

Failure to provide accurate and complete information may result in disqualification.

 

 

11. PRIZE DELIVERY AND CLAIM CONDITIONS

Prize delivery will be coordinated directly by the Tivoli Homes Marketing team.

  • Delivery may occur at the winner’s residence or at a mutually agreed location
     

  • The winner must present valid identification that matches the information provided digitally
     

  • If the winner is unable to claim the prize personally, they may designate a representative
     

In such cases:

  • The winner must notify the Organizer in advance via direct message
     

  • The representative must present valid identification
     

  • The Organizer may request documentation authorizing the representative
     

 

 

12. DOCUMENTATION OF PRIZE DELIVERY

The Organizer may document the prize delivery process through:

  • A signed receipt confirming delivery
     

  • Photographs or video of the winner receiving the prize
     

This documentation may be used for promotional and verification purposes.

 

 

13. PRIZE CLAIM DEADLINE

Winners will have up to thirty (30) calendar days from the date of announcement to claim their prize.

Failure to claim the prize within this period will result in forfeiture of the prize, and the Organizer reserves the right to select a new winner.

The Organizer shall not be held responsible for unclaimed prizes.

 

 

14. SUSPENSION OR CANCELLATION

The Organizer reserves the right to suspend, modify, or cancel the promotion immediately and without prior notice if:

  • Fraud, manipulation, or irregularities are detected
     

  • Technical failures or external platform issues occur
     

  • Force majeure events or circumstances beyond the Organizer’s control arise
     

In such cases, the Organizer’s sole obligation will be to communicate the suspension through its official channels.

Participants shall not be entitled to any compensation, claim, or indemnification.

 

 

15. ACCEPTANCE, PUBLICITY, AND PRIVACY

By participating, entrants agree to:

a) Limitation of Liability
Participation is at the participant’s own risk. The Organizer shall not be liable for any damages or losses arising from participation.

b) Use of Image
By accepting a prize, the winner agrees to allow the Organizer to capture and use their image, name, and likeness for promotional purposes without additional compensation.

c) Privacy Notice

Once personal data has been provided to the Organizer, it will be stored using secure systems and technologies designed to protect its integrity and confidentiality.

  • Access to such data will be restricted exclusively to authorized individuals and/or entities that maintain a legitimate business or legal relationship with the Organizer
     

  • Personal data may be shared with third parties solely for the purpose of administering and executing the promotion
     

  • The Organizer will implement appropriate technical and organizational measures to prevent unauthorized access, use, or disclosure of personal data
     

In the event of a lawful request by a competent authority, personal data may be disclosed in strict compliance with applicable laws and regulations.
 

 

 

16. EXPENSES

Any costs associated with claiming or receiving the prize, including transportation or personal expenses, shall be the sole responsibility of the winner.

 

 

17. PARTICIPATION RESTRICTIONS

The following individuals are not eligible to participate:

  • Employees, contractors, or affiliates of Tivoli Homes
     

  • Immediate family members of the above
     

  • Accounts identified as fake, inactive, or fraudulent
     

  • Accounts primarily used to participate in giveaways
     

Only residents of the United States are eligible.

Participants under 21 years of age may participate but must be accompanied by a legal guardian to claim the prize, as previously stated.

 

 

18. INFORMATION

19. GOVERNING LAW AND INTERPRETATION

These Terms and Conditions shall be governed by the laws of the State of Oklahoma, United States.

The Organizer reserves the exclusive right to interpret these Terms and resolve any disputes, provided such interpretation is not contrary to applicable law.

 

 

19. INTEGRITY OF THE PROMOTION

Any attempt by a participant to manipulate, alter, or compromise the integrity of the promotion will result in immediate disqualification and may lead to legal action.

 

 

20. COMPANY OBLIGATIONS

The Organizer agrees to:

  • Maintain a record of winners and prize distribution for a reasonable period
     

  • Ensure that all prizes are awarded or properly reassigned
     

  • Clearly communicate the promotion period and available prizes
